When you give us your shipment, you agree to our terms and conditions, which constitute the entire contract between you (the sender) and us (Speed Worldwide Express). By accepting our terms, you also agree on behalf of anyone else with an interest in the shipment. Our terms and conditions provide protection to any party contracted by us to collect, transport, or deliver your shipment. Please note that no employee or representative of Speed Worldwide Express has the authority to alter your terms and conditions or make any promises on our behalf.
1. The Airway Bill
The SPEED WORLDWIDE EXPRESS International waybill cannot be negotiated and is non-transferable.
2. Unacceptable Shipments/Shipment: We Do Not Accept
The Shipper acknowledges that their shipment is acceptable for transportation and deemed unacceptable if it falls under any of the following categories:
- Classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organisation), or any relevant government department or organization.
- No customs declaration is made when required by applicable customs regulations.
- Speed Worldwide Express determines that it cannot transport the item safely or legally. Such items include animals, bullion, currency, bearer form negotiable instruments, precious metals and stones, firearms, parts thereof and ammunition, human remains, pornography, and illegal narcotics/drugs.
3. Chargeable Weight
The chargeable weight of the shipment is calculated based on the higher value between the actual weight and volumetric weight. The volumetric weight is calculated by dividing the gross cubic volume in cubic centimeters by 5000.
4. Inspection of Shipment
Speed Worldwide Express reserves the right (but not the obligation) to open and/or inspect any shipment, and also has the right to refuse any shipment that does not conform to the terms and conditions without providing any reason whatsoever. Speed Worldwide Express also reserves the right to open and inspect a shipment without prior notice to the Shipper. By giving us your shipment, you agree that we may open and inspect it at any time and for any reason.
5. Deliveries & Undeliverable
The policy regarding the delivery of shipments and undeliverable items is as follows: shipments cannot be delivered to PO box or postal codes, and are instead delivered only to the address given by the shipper for the receiver. It should be noted that the receiver may not necessarily be the person named as the recipient of the shipment. Shipments that are addressed to a central receiving area will be delivered to that area.
In the event that the receiver refuses delivery, refuses to pay for the delivery, or if the shipment is deemed to be unacceptable or undervalued for customs purposes, and if the receiver cannot be reasonably identified or located, the courier company shall make reasonable efforts to return the shipment to the shipper. However, if these efforts are unsuccessful, the shipment may be released, disposed or sold by the courier company without incurring any liability to the shipper or anyone else. Any proceeds from the sale of the shipment will be applied towards service charges and related administrative costs, with any remaining balance to be returned to the shipper.
6. Claims
In order to make a claim for a lost or damaged shipment, you must submit your claim in writing to Speed Worldwide Express. This must be done within thirty (30) days from the date that Speed Worldwide Express accepted the shipment. If you do not submit your claim within this timeframe, Speed Worldwide Express will not be liable for any damages or losses incurred.
It is important to note that the term “lost” also includes instances where a shipment has been misdelivered. If you wish to make a claim for either a lost or damaged shipment, you must do so in writing within 30 days of the date that your shipment was accepted by Speed Worldwide Express. This timeframe is strictly enforced, and any claims made outside of this window will not be accepted by Speed Worldwide Express.
7. Delayed Shipments
The following is a revised version of the given text:
When it comes to delayed shipments, Speed WorldWide Express will try its best to deliver them within its regular delivery schedules. However, it’s important to note that these schedules are not guaranteed and are not part of the contract. If there are any damages or losses caused by delays, Speed WorldWide Express cannot be held liable.
Similarly, Speed WorldWide Express will also make reasonable efforts to deliver shipments according to their regular delivery schedules, but these schedules are not guaranteed and are not considered part of the contract. Therefore, Speed WorldWide Express cannot be held responsible for any damages or losses caused by delays.
8. Severability
If any part of these Terms and Conditions is found to be invalid or unenforceable, it will not impact the validity or enforceability of any other provision in these Terms and Conditions.
